Welcome to CalCreationsIRL. These Terms of Service apply to your use of our website and to purchases made through our online store.
In these Terms, “we”, “us” and “our” mean CalCreationsIRL. “You” and “your” mean the customer or person using our website.
By accessing or using our website, or placing an order with us, you agree to these Terms of Service and the policies referred to in them.
Please read these Terms carefully before using our website or placing an order. Nothing in these Terms affects your statutory rights as a consumer under Irish or European Union law.

SECTION 1 – USING OUR WEBSITE
You may use our website for lawful purposes only.
You agree to provide accurate and complete information when placing an order or contacting us.
You must not use our website in a way that could damage, disable, overburden or interfere with the website or prevent other customers from using it.
We reserve the right to refuse access to our website where there is a legitimate reason to do so, including misuse of the website or fraudulent activity.
SECTION 2 – OUR PRODUCTS
We make every reasonable effort to ensure that product descriptions, photographs, colours and other information on our website are accurate.
Colours and the appearance of products may vary slightly depending on your device, monitor or screen settings.
Some of our products are handmade, personalised, customised or 3D printed. Because of the nature of these products, minor variations in colour, finish, texture or appearance may occur.
Where a product is personalised or customised, you are responsible for ensuring that the information you provide to us, including names, dates, spelling and other personalisation details, is correct before placing your order.
We will make products according to the information and specifications provided by you.
Nothing in this section limits your statutory rights where a product is faulty, damaged, unsafe, not as described or otherwise does not conform to the contract.
We reserve the right to update product descriptions, discontinue products or change availability. Any changes will not affect an order that we have already accepted unless required by law.
SECTION 3 – ORDERS
When you place an order through our website, you are making an offer to purchase the products selected by you.
After placing an order, you will normally receive an order confirmation by email. This confirms that we have received your order but does not necessarily mean that your order has been accepted.
A contract between you and CalCreationsIRL is formed when we confirm that your order has been accepted and we have received payment.
We reserve the right to refuse or cancel an order where there is a genuine reason to do so, including where a product is unavailable, there is an obvious pricing or product description error, or we reasonably suspect fraudulent activity.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
Please check your order carefully before completing your purchase, particularly where products are personalised or customised.
SECTION 4 – PERSONALISED AND CUSTOM PRODUCTS
Personalised and custom products are made specifically according to the information or specifications provided by you.
Because these products are made specifically for you, the statutory right to cancel a distance purchase due to a change of mind may not apply to personalised or made-to-order products where the law provides an exception.
This does not affect your statutory rights if a personalised or custom product is faulty, damaged, unsafe, not as described or otherwise does not conform to the contract.
We cannot be responsible for errors in personalisation where the incorrect information was supplied by the customer.
If you notice an error in your personalisation details after placing an order, please contact us as soon as possible. We will try to accommodate changes before production begins, but changes may not be possible once production has started.
SECTION 5 – PRICES AND PAYMENT
All prices displayed on our website are in euro (€).
Where applicable, VAT is included in the displayed price.
Any delivery charges or other additional charges will be clearly displayed before you complete your purchase.
Prices may change from time to time, but changes will not affect orders that have already been accepted.
We use third-party payment providers to process payments. We do not store your full payment card details.
You agree to provide accurate and complete billing, payment and contact information when placing an order.
SECTION 6 – SHIPPING AND DELIVERY
We will aim to dispatch your order within the timeframe stated on the relevant product page or at checkout.
Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, including courier delays, severe weather, industrial action or other unforeseen events.
We will provide delivery information at checkout where applicable.
We remain responsible for your order until it is delivered to you or to a person nominated by you, in accordance with applicable consumer law.
If your order arrives damaged, is lost, or you receive the wrong item, please contact us as soon as possible so that we can investigate and put things right.
SECTION 7 – RETURNS, CANCELLATIONS AND REFUNDS
Your cancellation, return and refund rights are explained in our Return and Refund Policy.
Where you purchase eligible goods online, you generally have a statutory 14-day cooling-off period in which to cancel your purchase. Certain products, including personalised or made-to-order products, may be excluded from this right where permitted by law.
Nothing in these Terms affects your statutory rights regarding faulty, damaged, unsafe, incorrectly described or non-conforming goods.

SECTION 8 – DAMAGED, FAULTY OR INCORRECT PRODUCTS
Please inspect your order when you receive it.
If your product is damaged, faulty, defective, unsafe, incorrect or does not match the description, please contact us as soon as possible and provide details of the issue. Photographs may be requested where appropriate to help us assess the problem.
Your statutory consumer rights are not affected by our returns policy.
Where a product does not conform to the contract, we will provide the appropriate remedy required under applicable consumer law.
SECTION 9 – INTELLECTUAL PROPERTY
All content on this website, including our photographs, graphics, logos, product designs, text, branding and other materials, belongs to CalCreationsIRL or is used with permission.
You may view and use the website for your personal, non-commercial purposes.
You must not reproduce, copy, modify, distribute, sell or commercially exploit our website content, photographs, designs, branding or other intellectual property without our prior written permission.
